Terms of use
Thank your for using UndiQ, a free online and mobile service for customizing, communicating, creating and sharing content for your mobile device. By accessing the UndiQ.mobi (“UndiQ”) website (“Site”) or using the services ("Services") offered by UndiQ you agree and acknowledge to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms or to our Privacy Policy, please do not access the Site or use the Services. UndiQ reserves the right to change these Terms at any time. We recommend that you periodically check this Site for changes.
1. Usage License
UndiQ grants you a limited license to access the Site and use the Services in accordance with these Terms and the instructions and guidelines posted on the Site. UndiQ reserves the rights to terminate your license to use the Site and Services at any time and for any reason or in the future charge for commercial usage.
2. User Responsibility
You are solely responsible for your use of the Site and Services. Because UndiQ merely serves as a repository of information, user-posted content does not represent the advice, views, opinions or beliefs of UndiQ, and UndiQ makes no claim of accuracy of any user-posted material. UndiQ allows for the posting of links to third-party websites. The linked websites' content, business practices and privacy policies are not under our control, and we are not responsible for the content of any linked website or any link contained in a linked website. The inclusion of a user-submitted link on the Site or Services does not imply any endorsement by or any affiliation with UndiQ. In accessing the Site and Services or following links to third-party websites you may be exposed to content that you consider offensive or inappropriate. You agree that your only recourse is to stop using the Site and Services.
3. User-Posted Content
By posting content, you are granting permission to us and others to access and use it in connection with the Services, the Site and otherwise in connection with our business. You can mark content as private to restrict access and use to yourself only.
UndiQ is explicitly not responsible for the manner or circumstances by which third parties access or use public content and is under no obligation to disable or otherwise restrict this access.
4. Intellectual Property (Trademarks & Copyrights)
UndiQ, the UndiQ logo, UndiQ design and "Made for your mobile, everywhere. you" phrase are trademarks or trade dress of UndiQ, and may not be used without express written permission from UndiQ, other than for attribution. All other trademarks not owned by UndiQ that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by UndiQ.
UndiQ-originated content included on the Site, such as text, graphics, logos, data compilations, software and the compilation of all content on the Site, is the property of UndiQ and its licensors and protected by European Union and international copyright laws. Except as set out in these Terms, no reproduction of any UndiQ-originated content is permitted without written permission from UndiQ.
UndiQ delivers aggregated content from RSS feeds made freely available by various content providers, and does not claim any copyright, license, or other ownership to material in these feeds., UndiQ does not control the content in any such RSS feeds or content sources.
User-posted content is copyrighted, and any use or reproduction of user-posted content must comply with the terms of the respective license(s) and must include a label indicating such license.
5. No Warranty and Limitation of Liability
UNDIQ PROVIDES THE SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. UNDIQ SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEGRATION, INTEROPERABILITY OR QUIET ENJOYMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.
You understand and agree that you use the Site and Services at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. 6. Copyright Policy
UndiQ claims no intellectual property rights over the Materials submitted to UndiQ via the Service.
If you believe that your work has been posted on UndiQ.mobi in a way that constitutes copyright infringement, please contact UndiQ and provide the following information:
-An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
-A description of the copyright work that you claim has been infringed, and identification of the URL or other specific location on UndiQ where the Content that you claim is infringing is located;
-Your address, telephone number, and email address;
-A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
-A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
UndiQ has made every effort to secure permission to use images and material contained within its website and is more than willing to remove them if it is proven that they own the copyright to it and have not given permission for it's use.
In ALL cases the decision of the relevant copyright holder remains final.
If you download any materials that UndiQ.mobi indexes or supports, you do so completely at your own risk. If you plan to download any software, please be sure to read the respective copyright and licensing information first.
7. Changes to Service and Terms
UndiQ reserves the right to change the Service or these Terms at any time. We reserve the right to refuse service to anyone for any reason at any time. We recommend that you periodically check this Site for changes.
8. Submitting content
By submitting, posting or displaying any Content, materials or other subject matter of any kind (collectively, .Materials.) on or through UndiQ, you automatically grant to us a worldwide, non-exclusive, sub-licensable, transferable, royalty-free, perpetual, irrevocable right to copy, distribute, create derivative works, publicly perform, display and otherwise exploit such Materials. That said, our use of your personal information is governed by our Privacy Policy and we will never rent, sell or share your personal information with any third party for marketing purposes without your express permission.
9. Other
UndiQ and you are independent entities, and nothing in the Terms, or via use of the Site or Services, will create any partnership, joint venture, agency, franchise, sales representative employment relationship or similar things between UndiQ and you.
These Terms supersede any previous agreement and represent the entire agreement between UndiQ and you. These Terms are governed by the laws of the Kingdom of the Netherlands without reference to conflict of laws principles. If any provision of the Terms is adjudged to be illegal or unenforceable, the continuation in full force of the remainder of the Terms will not be prejudiced, and the illegal or unenforceable provision of the Terms shall be severed accordingly. Any notices must be sent to UndiQ in English.
